These Terms and Conditions (the "Terms") govern access to and use of the Santelle website available at www.santellehealth.com (the "Website"), the Santelle mobile application (the "App"), and the purchase and use of Santelle test kits and related digital services (together, the "Services").
The Services are operated by Santelle SARL, a company incorporated under the laws of Switzerland, with registered offices at 5B Route de Pressy, 1243 Vandoeuvres, Switzerland ("Santelle", "we", "us", "our").

By accessing or using the Website, the App, or purchasing a Santelle test kit, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Services.
1. ELIGIBILITY
1.1 The Services are intended for individuals aged 16 years or older. By using the Services, you confirm that you meet this age requirement.
1.2 If you are under 18 years of age, you confirm that you have obtained the consent of a parent or legal guardian to use the Services and to enter into these Terms.
1.3 You must be legally capable of entering into binding contracts in your jurisdiction to purchase products or create an account.
1.4 By accepting these Terms, you confirm that you have the legal capacity and authority to enter into a legally binding contract with Santelle in accordance with applicable law.
2. DESCRIPTION OF THE SERVICES
2.1 Santelle offers physical at-home vaginal health self-test kits (the "Test Kits") and a companion App that provides:
Display of test results (including positive/negative indicators);
Educational information explaining what such results typically mean;
General, non-personalised information on common pathways or next steps that are typically associated with such results.
2.2 The App is strictly informational and educational. It does not provide medical advice, diagnosis, treatment, or prescriptions. Any information provided by the app should be used in addition to medical consultation and advice and not in lieu of the advice of a trained medical professional.
2.3 The Services are not a medical device, not an in vitro diagnostic, and not a substitute for professional medical consultation.
3. ACCOUNT CREATION AND ACCESS
3.1 When purchasing a Test Kit, a user account is automatically created for access to the App.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. However, you will need to confirm compliance with these terms and conditions prior to being able to utilize the app.
3.3 Santelle reserves the right to suspend or terminate accounts that are used in violation of these Terms.
4. APP ACCESS DURATION
4.1 Access to the App is granted based on the number of Test Kits purchased:
1 Test Kit: 3 months of App access;
3 Test Kits: 12 months of App access;
4.2 Santelle may modify App features, content, or functionality over time. No consent is needed for Santelle to enhance, modify, improve, change, or update the App and any features within the App.
5. ORDERS AND PAYMENT
5.1 Purchases are made through the Website using Shopify Payments.
5.2 Prices are displayed in the local currency applicable to the purchaser’s location and may include applicable taxes.
5.3 Santelle reserves the right to refuse or cancel orders at its discretion.
6. SHIPPING
6.1 Test Kits are shipped from Switzerland to Switzerland, the European Union, and the United Kingdom.
6.2 Delivery times are indicative only and not guaranteed.
7. RETURNS AND REFUNDS
7.1 In accordance with applicable consumer protection laws, consumers in the EU and UK may have a 14-day right of withdrawal from the date of receipt.
7.2 Due to hygiene and safety reasons, sealed Test Kits cannot be returned once opened or unsealed.
7.3 No refunds will be issued for:
Opened or used Test Kits;
Digital services once App access has been granted or content delivered.
7.4 Unopened and sealed Test Kits may be returned in accordance with Santelle’s return instructions.
8. INFORMATIONAL USE AND DISCLAIMERS
8.1 The Services provide general informational and educational content only.
8.2 Any information presented as "typical" pathways, outcomes, or actions reflects general educational knowledge and does not take into account your personal medical history, symptoms, or circumstances.
8.3 You acknowledge and agree that you must not rely on the Services as a basis for making health, medical, or treatment decisions.
8.4 Santelle does not guarantee the accuracy, completeness, reliability, timeliness, or suitability of any information provided through the Services, including test results or explanatory content.
8.5 Santelle shall not be responsible or liable for any actions taken or not taken by you based on information obtained through the Services.
8.6 The Services are not intended for emergency use. If you have urgent symptoms or concerns, you should seek immediate professional medical assistance.
9. USER DATA AND PRIVACY
9.1 Use of the Services involves the processing of personal and sensitive health data.
9.2 Santelle processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms and is incorporated herein by reference.
9.3 By using the Services, you consent to such processing.
10. INTELLECTUAL PROPERTY
10.1 All content, software, trademarks, and materials forming part of the Services are owned by or licensed to Santelle.
10.2 You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
11. PROHIBITED USES
You agree not to:
Misuse the Services;
Attempt to reverse engineer the App;
Use the Services for unlawful purposes;
Interfere with the security or integrity of the Services;
Fail to seek advice from a medical professional.
12. LIMITATION OF LIABILITY
12.1 To the maximum extent permitted by applicable law, Santelle shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, emotional distress, anxiety, or health-related outcomes.
12.2 Santelle shall not be liable for any damages arising from:
reliance on informational content;
incorrect interpretation of test results;
delays, interruptions, or unavailability of the Services;
events outside Santelle’s reasonable control.
12.3 Santelle’s total aggregate liability arising out of or in connection with the Services shall not exceed the amount paid by you for the relevant Test Kit giving rise to the claim.
12.4 Nothing in these Terms limits liability that cannot be excluded under applicable law, including mandatory consumer protection rights.
13. INDEMNIFICATION
13.1 You agree to indemnify and hold harmless Santelle, its directors, officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
your misuse of the Services;
your breach of these Terms;
your violation of applicable laws or third-party rights.
14. MODIFICATION OR TERMINATION OF SERVICES
14.1 Santelle may modify, suspend, or discontinue the Services at any time, for any reason, with or without cause.
14.2 Where reasonably possible, Santelle will provide notice of material changes, but is not required to provide prior written notice.
15. GOVERNING LAW AND JURISDICTION
15.1 These Terms are governed by Swiss law.
15.2 The courts of Geneva, Switzerland, shall have exclusive jurisdiction.
16. THIRD-PARTY SERVICES
16.1 The Services may rely on third-party platforms or service providers, including payment processors and hosting providers.
16.2 Santelle is not responsible for the availability, performance, or acts or omissions of such third parties.
17. FORCE MAJEURE
17.1 Santelle shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, strikes, supply chain disruptions, governmental actions, or technical failures.
18. MISCELLANEOUS
18.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.2 Santelle may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
